Terms of Service

These Terms of Service explain the rules, responsibilities, and acceptable use requirements for DDC Game Servers customers, including paid services and our free 72-hour trial servers.

1. Agreement to Terms

By purchasing, accessing, using, or participating in any service provided by DDC Game Servers (“Company”, “we”, “our”, or “us”), including game servers, VPS services, dedicated services, Pterodactyl panel access, web hosting, trial services, or related infrastructure, you (“Customer”, “User”, or “Client”) agree to be bound by these Terms of Service.

If you do not agree to these Terms, you may not use our services.

2. Services Provided

DDC Game Servers provides infrastructure and hosting-related services including:

  • Game server hosting
  • Pterodactyl panel hosting
  • Trial game server deployments
  • VPS hosting and dedicated resource hosting
  • File storage associated with hosted services
  • Related networking and hosting infrastructure

All services are provided on a best-effort basis unless otherwise specified in writing.

3. Eligibility and Account Responsibility

You must be at least 18 years old, or have permission from a legal guardian, to purchase or use our services.

You are responsible for all activity performed under your account, including activity performed by users, sub-users, staff members, players, or third parties given access to your server or panel.

4. Trial Program (72 Hour Free Trial)

DDC Game Servers may offer free trial servers for temporary evaluation purposes.

  • Trial servers are temporary and may be suspended, limited, or terminated at any time.
  • Trial access does not guarantee eligibility for paid services.
  • Trial data may be deleted at any time.
  • Abuse of the trial system may result in permanent denial of future service.
  • We reserve the right to deny, reject, or revoke trial access without explanation.

All acceptable use rules apply during the free trial and continue to apply after the trial period ends.

5. Acceptable Use Policy

Customers may not use our services for any activity that violates local, state, federal, or international law.

Network Abuse

  • DDoS or DoS attacks
  • Port scanning without authorization
  • Network flooding or malicious traffic generation
  • IP spoofing or botnet activity
  • Interference with upstream providers or other customers

Illegal or Harmful Content

  • Illegal content or unauthorized file distribution
  • Malware, ransomware, spyware, trojans, or exploit hosting
  • Phishing, credential theft, or fraudulent activity
  • Copyright infringement
  • Content intended to harass, threaten, or harm others

Platform Abuse

  • Excessive resource abuse affecting node stability
  • Cryptocurrency mining without written authorization
  • Circumventing allocated limits
  • Unauthorized account sharing or resale
  • Exploiting vulnerabilities in our systems or panel software

Game Server Abuse

  • Hosting cheats, malware, or malicious modifications
  • Using servers for malicious automation or attacks
  • Ban evasion from our network
  • Abuse of free trial deployments

6. Right to Suspend or Terminate Services

DDC Game Servers reserves the right to suspend, restrict, terminate, remove, or refuse service at any time.

This includes situations where we suspect a violation of these Terms, receive abuse reports or complaints, believe activity may threaten infrastructure stability, suspect illegal activity, determine a customer presents elevated operational or financial risk, or believe continued service may expose DDC Game Servers to legal, operational, or reputational harm.

Suspicion-Based Enforcement

We reserve the right to suspend or terminate services based on reasonable suspicion of abuse or Terms violations, even if a formal investigation has not concluded.

This right applies both during and after any free trial period. We are not required to provide advance warning before taking action.

7. Refunds, Payments, and Chargebacks

Unless otherwise stated in writing, payments for active services are generally non-refundable. Trial services are not eligible for compensation or credits.

Refund requests may be reviewed on a case-by-case basis. Chargebacks, payment disputes, suspected fraud, or unauthorized payment activity may result in immediate suspension or permanent account termination.

8. Data Loss and Backups

Customers are solely responsible for maintaining backups of their data.

While DDC Game Servers may maintain internal backups for operational purposes, we do not guarantee the availability, integrity, or restoration of customer data.

We are not liable for data loss, corruption, service interruptions, deleted files, failed backups, hardware failure, third-party outages, or other interruptions outside our control.

9. Uptime and Service Availability

We strive to provide stable and reliable hosting services. However, no uptime guarantee is implied unless explicitly stated in writing.

Maintenance, hardware failures, upstream provider issues, attacks, software issues, or emergency maintenance may result in downtime. We are not responsible for losses caused by downtime or service interruptions.

10. Resource Allocation and Fair Use

Services are subject to reasonable fair use standards. We reserve the right to limit excessive resource consumption, suspend overloaded instances, adjust allocations to preserve node stability, and restrict abusive disk, CPU, memory, or network usage.

Dedicated allocations apply only to the specific plan purchased and do not grant unrestricted access to underlying hardware.

11. Customer Responsibilities

Customers are responsible for securing passwords and account access, maintaining updated software where applicable, monitoring activity on their hosted services, complying with applicable laws, and managing users who are granted access to their servers.

Any action performed through a customer account is considered the responsibility of the account owner.

12. Limitation of Liability

To the maximum extent permitted by law, DDC Game Servers shall not be liable for indirect damages, consequential damages, lost revenue, lost profits, data loss, service interruptions, business interruption, hardware failures, or third-party actions.

Total liability under any claim shall not exceed the amount paid by the customer for the affected service during the prior 30 days.

13. Indemnification

Customers agree to indemnify and hold harmless DDC Game Servers, its operators, affiliates, contractors, and providers from any claims, liabilities, damages, losses, legal fees, or expenses resulting from customer misuse of services, violations of these Terms, illegal activity, customer-hosted content, or third-party claims related to customer activity.

14. Privacy, Logging, and Abuse Monitoring

DDC Game Servers may retain logs, connection data, usage information, and related operational records for security monitoring, abuse prevention, infrastructure diagnostics, legal compliance, and network protection.

We reserve the right to cooperate with valid legal requests where required by law.

15. Changes to Services or Terms

We reserve the right to modify services, change pricing, adjust allocations, update these Terms of Service, or discontinue services. Continued use of services after changes constitutes acceptance of the updated Terms.

16. Governing Law

These Terms shall be governed by and interpreted under the laws applicable in the United States and the State of Oregon, without regard to conflict of law principles.
